Litigation and Arbitration

Litigation has always been our strength. We started as a litigation firm and have a long and significant experience representing and defending clients in disputes in the areas of commercial law, corporate, antitrust, banking, real estate, torts, intellectual property, procurement, commercial contracts and insolvency proceedings. The firm represents its clients at every stage and level of civil litigation, including before the Supreme Court, the Court of Justice of the European Union and the ECHR. Our Partners have extensive experience as members and chairmen of arbitration tribunals, including in administered arbitrations such as those held before the Arbitration Chamber of the National Anti-Corruption Authority and Chambers of Commerce. Some of them have extensive teaching and training experience in arbitration law within university and post-graduate courses. All of the firm’s lawyers have specific experience as arbitrator or defence counsel in arbitration proceedings. The firm also assists clients in mediation proceedings or other ADR (Alternative Dispute Resolution) systems.

Transnational Litigation

The firm also has consolidated experience in litigation with transnational profiles. Specifically, we assist Italian and foreign companies in commercial litigation before national courts, in interim measures proceedings linked to disputes pending in other countries, as well as for the enforcement in Italy of judgments and orders issued by foreign courts and foreign arbitration awards. Prof. Ulisse Corea, Lawyer, has assisted leading multinational companies, also in cooperation with foreign law firms, advising and drafting legal opinions and expert reports especially on law of civil procedure and international private and procedure law matters.

Enforcement Proceedings

The firm assists in all types and phases of enforcement proceedings, from expropriation to specific performance of delivery, release, orders to act or abstain from an act, including related proceedings for opposition to enforcement and enforcement actions, applications for suspension and complaint proceedings. We assist leading companies holding major credit portfolios and national and international investment funds. Prof. Ulisse Corea, Lawyer, authored several publications on the subject and is a member of the Scientific Evaluation Committee of the series Rassegna dell’esecuzione forzata (Enforcement Proceedings Review), Edizioni Scientifiche Italiane. He has been a speaker at conferences on enforcement proceedings and oppositions.

Third Party Litigation Funding

The Firm has long been engaged in the study of solutions for Third Party Litigation Funding, i.e. litigation funding agreements. These are wagering contracts in which a funding party makes its resources available for the benefit of another party that intends to engage in litigation but does not have sufficient means to support or complete it, receiving in return a share of any proceeds. This type of agreement has several problematic aspects, which must be resolved by finding a balance in the negotiation between the parties: from the due diligence in the pre-contractual phase to the modalities of disbursement of the financing, from the regulation of the powers of the lender to that of the information flows that the financed party must ensure, from the reporting obligations of the financed party to those of confidentiality, to the possible conflict of interest between the parties and the lawyers themselves. The Firm is engaged in the drafting of contracts for the financing of in-court and arbitration disputes abroad for the recognition and collection of large claims held by leading companies in relation to tender contracts for the implementation of major infrastructures.

Class Actions

The firm assists clients in collective and consumer litigation and has always closely followed the developments in the field of class actions, analysing the topic also in academia and in publications.
